Terms & Conditions

These Terms & Conditions outline the rights and responsibilities of members, visitors and No Limits 24/7 Health Clubs. Please read them carefully before joining, purchasing a visit product or using the Club.

Important: These Terms & Conditions apply to all memberships, prepaid memberships, Visit Packs, Casual Visits, visitors and any other person accessing No Limits 24/7 Health Clubs, unless expressly stated otherwise.

1. Definitions

  • Terms & Conditions means these Terms & Conditions together with any membership details displayed or accepted during sign-up.
  • Business Day means a day other than a Saturday, Sunday or public holiday in Victoria.
  • Club means No Limits 24/7 Health Clubs Maryborough and any other locations operated by No Limits Health Clubs Pty Ltd.
  • Member / You / Your means the individual entering these Terms, including a parent or legal guardian accepting them for a minor.
  • Digital Cancellation Form means the official cancellation form issued and approved by No Limits 24/7 Health Clubs.
  • Membership Hold means a temporary membership pause approved by the Club.
  • Membership Service Fee means the quarterly administration and facility support fee described in these Terms.
  • Visitor includes casual visitors, guests, prospective members and approved support persons.

2. Membership Rights & Responsibilities

2.1 Membership Access

  • Membership provides access to the facilities, equipment and services included in the membership purchased.
  • Memberships are personal and cannot be transferred, assigned or resold without written approval.
  • The Club may add, remove, replace or modify equipment, facilities, services, hours, access systems or features.

2.2 Access Rules & Tailgating

  • Access credentials are issued only for the member to whom they are assigned.
  • Each member must activate their own access credential every time they enter.
  • The Club uses access monitoring and tailgating detection systems.
  • Unauthorised entry includes sharing credentials, allowing another person to enter without authorisation or bypassing entry procedures.
  • A breach may result in a $150 Non-Compliance Fee, suspension, termination or a combination of these actions.

2.3 Member Responsibilities

  • Wear suitable clothing and enclosed footwear.
  • Maintain appropriate hygiene and avoid bringing dirt, mud or debris into the Club.
  • Respect staff, members, visitors and Club property.
  • Re-rack weights and return equipment after use.
  • Follow Club signage and reasonable staff directions.
  • Report faults, injuries, accidents and hazards promptly.
  • Use equipment safely and only for its intended purpose.
Additional cleaning may attract a fee of up to $50. Failure to return weights or equipment may attract a re-racking fee of up to $50.

2.4 Age Requirements

  • The minimum membership age is 14 years.
  • Members under 18 require a parent or legal guardian to accept these Terms on their behalf.
  • The Club may request proof of age at any time.

2.5 Student Membership Eligibility

Student Memberships are available only to eligible new members who are secondary school students aged 14 to 19 and hold current valid student identification.

  • Clear front and back copies of student identification may be required.
  • Eligibility may be verified with the issuing school or institution.
  • Student memberships are non-transferable, cannot be combined with other offers unless stated, and are subject to promotional availability.
  • If eligibility is not established, the Club may move the member to a standard membership, amend the membership or cancel it.
  • After the advertised promotional period, the membership continues at the standard weekly rate unless cancelled under these Terms.

2.6 Identification & Profile Photos

  • A profile photo is required for security, access verification and member identification.
  • Members aged 18 or older may be asked for government-issued photo identification.
  • Members under 18 may use student identification or parent/guardian verification.
  • The Club may request additional identification as a condition of ongoing membership.

3. Fees & Payments

Club Fees & Penalties Guide

Dishonour Fee — $9.95Applied to failed direct debit transactions.
Membership Service Fee — $9.95Charged quarterly to ongoing weekly direct debit memberships.
Non-Compliance Fee — $150May apply to tailgating, credential sharing or unauthorised access.
Cleaning / Re-Racking — up to $50May apply where extra cleaning or equipment re-racking is required.

3.1 Membership Fees

Members agree to pay all fees applicable to their chosen membership. Fees and charges displayed during sign-up form part of these Terms.

3.2 Joining Fee

A one-time Joining Fee may apply to new memberships and reactivations. The current amount is shown during sign-up and may be waived, reduced or discounted by the Club.

3.3 Direct Debit Establishment Fee

A direct debit establishment fee may apply where ongoing payments are processed through a direct debit facility. The current fee is disclosed during sign-up.

3.4 Pro-Rata Payment

A pro-rata payment may cover the period between joining and the first scheduled debit. The final amount will be shown before sign-up is completed.

3.5 Dishonoured Payments

  • A Dishonour Fee of $9.95 applies to failed direct debit transactions.
  • The outstanding balance remains payable and may be re-attempted automatically.
  • Outstanding amounts may be added to future scheduled debits.
  • Club access may be suspended until the account is brought up to date.

3.6 Debt Recovery

Where amounts remain unpaid, the Club may suspend access, terminate membership, refer the debt to a collection agency or commence legal recovery. Reasonable recovery costs may be payable where permitted by law.

3.7 Membership Fee Changes

The Club may review and adjust membership fees, charges and service fees. Reasonable notice will be provided where required by law.

3.8 Membership Service Fee

A quarterly Membership Service Fee of $9.95 applies to ongoing weekly direct debit memberships. It supports administration, billing and access systems, mobile app services, maintenance, facility upkeep and Club improvements.

Prepaid memberships are not charged this fee separately because it is included in prepaid pricing.

3.9 Referral Program

Referral programs may be offered from time to time. Eligibility, rewards and conditions are determined by the promotion in effect and may be amended or withdrawn.

3.10 Visit Packs

  • Visit Packs are for individual use and cannot be shared.
  • They are non-refundable and non-transferable unless required by law.
  • Each visit is limited to a maximum of three hours.
  • Unused visits expire three months from purchase.
  • No Joining Fee applies.

3.11 Casual Visits

  • A Casual Visit provides access for one visit only.
  • The pass must be activated within seven days of purchase.
  • It activates on first entry and lasts for a maximum of three hours.
  • Exit and re-entry are permitted during the active three-hour period.
  • Casual Visits are non-refundable and non-transferable.

3.12 Prepaid Memberships

  • Prepaid memberships provide access for the prepaid period purchased.
  • They are generally non-refundable and non-transferable.
  • No credit, refund or extension is provided for unused time unless required by law.
  • They expire automatically at the end of the prepaid period.
  • Approved Membership Holds may apply under clause 4.3.

4. Cancellation, Membership Holds & Termination

4.1 Cooling-Off Period

  • Members may cancel within 48 hours of joining.
  • The standard 30-day notice period does not apply during cooling-off.
  • Future payments stop and access ends immediately.
  • The Joining Fee and pro-rata payment are non-refundable.

4.2 Member Cancellation

  • Cancellations after cooling-off must be submitted using the official Digital Cancellation Form.
  • Phone, email, text, social media and verbal requests are not accepted as cancellation.
  • The form is primarily completed in the Club during staffed hours.
  • Members unable to attend may request a secure personalised cancellation link by emailing:

  • Cancellations are verified against GymMaster account records.
  • The official cancellation date is the date the completed form is processed by the Club.
  • The 30-day notice period begins from that official cancellation date.
  • Payments remain payable and access generally remains active during the notice period.

4.3 Membership Holds

  • Holds are subject to approval and may require the account to be substantially up to date.
  • Payments and access are suspended during the approved hold period.
  • Existing outstanding balances remain payable.
  • The standard maximum is eight weeks in any rolling 12-month period unless a longer period is approved.
  • Accessing the Club during a hold may automatically end the hold and restart regular billing.

4.4 Club-Initiated Suspension

The Club may suspend access for unpaid fees, rule breaches, access breaches, tailgating, misconduct or safety and security concerns. Suspension does not remove the obligation to pay outstanding amounts.

4.5 Club-Initiated Termination

The Club may terminate immediately for serious breaches, including credential sharing, tailgating, fraud, harassment, threatening behaviour, wilful damage or serious misconduct. No refund is provided where termination results from a member breach.

5. Health & Safety

5.1 Fitness to Exercise

Exercise and gym equipment involve inherent risks. Members confirm they are medically fit to exercise or have sought appropriate medical advice and are responsible for working within their own limitations.

5.2 Medical Conditions

Members should seek medical advice where an injury, illness or health concern may affect safe exercise and should notify the Club of significant health changes. The Club does not provide medical advice.

5.3 Equipment Use

  • Follow equipment instructions and use equipment only as intended.
  • Exercise safely and responsibly.
  • Report damaged or unsafe equipment promptly.
  • Return equipment to its designated location after use.

6. Club Rules

6.1 Dress Standards

Appropriate gym clothing and enclosed footwear must be worn. Offensive or inappropriate clothing may result in refusal of entry or removal.

6.2 Hygiene & Courtesy

  • Maintain appropriate personal hygiene.
  • Towel use and wiping down equipment are encouraged.
  • Behave respectfully toward staff, members and visitors.
  • Follow reasonable management directions.

6.3 Members Under 18

Members under 18 may use the Club only under their membership conditions and any parent or guardian consent. Parents and guardians remain responsible for them.

6.4 Personal Equipment

Personal fitness equipment may not be brought into the Club without prior approval. Approved personal equipment is used entirely at the member's risk.

7. 24/7 Access & Security

7.1 Club Access

  • Access is primarily provided through the GymMaster app and Bluetooth entry system.
  • Members must maintain their GymMaster account, compatible device, Bluetooth functionality and secure login details.
  • Credentials remain Club property and must not be shared, copied or transferred.
  • Lost, damaged or replacement access devices may incur a fee.

7.2 Access Technology

The Club is not responsible for temporary access issues caused by device faults, internet or network outages, software updates, Bluetooth issues, compatibility or user error.

7.3 Guest Entry During Unstaffed Hours

A member may permit a guest to enter during unstaffed hours only where the guest has purchased a valid Casual Visit and complies with Club rules. The member remains responsible for confirming valid entry authorisation.

7.4 Unstaffed Access

Members using the Club during unstaffed hours do so at their own risk, acknowledge staff may not be immediately available and must comply with all safety requirements.

7.5 Video Surveillance

The Club operates CCTV 24 hours a day for security, safety and operational purposes, excluding private areas. Footage and access records may be used for investigations, insurance matters, law enforcement requests and enforcement of Club policies.

7.6 Temporary Closures

The Club may temporarily close or restrict access due to maintenance, repairs, utility failures, emergencies, public health requirements or circumstances beyond its control. Temporary interruptions do not automatically entitle members to refunds or extensions unless required by law.

8. Personal Property & Lockers

8.1 Personal Property

Members and visitors are responsible for their belongings. The Club accepts no responsibility for lost, stolen, damaged or unattended property.

8.2 Lockers

Lockers are a convenience only and are not security devices. Items left overnight may be removed and unclaimed property may later be stored, donated or disposed of.

9. Personal Training, Coaching & Commercial Activities

9.1 Approved Trainers

Only trainers approved by No Limits 24/7 Health Clubs may provide personal training within the Club.

9.2 External Training & Coaching

Unauthorised personal training, coaching or instruction is prohibited. Approval may require qualifications, insurance, business details and a commercial usage fee.

9.3 Support Persons

Support persons, carers or disability support workers may be approved case by case. Approval must be obtained in advance and does not permit personal training or commercial activity.

9.4 Photography, Video & Promotional Material

  • The Club may photograph or record the facilities and general gym environment for promotional purposes.
  • Members may notify management in writing if they do not wish to appear in promotional material.
  • Members must not photograph or record others without consent.
  • Recording must not breach privacy, cause harassment or disrupt use of the Club.

10. Liability & Indemnity

10.1 Assumption of Risk

Members acknowledge that exercise and the use of gym equipment involves inherent risks, including injury, illness, disability or death, and voluntarily accept those risks.

10.2 Limitation of Liability

To the maximum extent permitted by law, No Limits Health Clubs Pty Ltd excludes liability for loss, damage, injury, expense or claims arising from use of the Club, exercise activities, equipment or staffed and unstaffed access.

Nothing in these Terms excludes rights that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

10.3 Indemnity

Members agree to indemnify the Club, its directors, employees, contractors, agents and representatives for claims or losses arising from a breach of these Terms, negligent conduct, misuse of facilities, unauthorised activities or damage caused by the member.

10.4 Property Damage

Members are responsible for damage caused to Club property through wilful, reckless or negligent conduct. Repair or replacement costs may be charged.

11. Privacy

The Club collects, stores and uses personal information for membership administration, access control, identity verification, security, billing, communication and legal compliance.

Profile photographs, identification documents, CCTV footage and access records may be retained and used for security, incident investigation, membership administration and law enforcement assistance where reasonably required.

Members consent to the collection, storage and use of personal information for these purposes.

12–18. General Terms

12. Electronic Communications

The Club may communicate notices, reminders, fee changes and membership information by email, SMS, GymMaster, the Member Portal or other electronic means.

13. Force Majeure

The Club is not responsible for delay or failure caused by events beyond its reasonable control, including natural disasters, fire, flood, pandemic, government action, utility failure, internet outage or industrial action.

14. Entire Terms & Conditions

These Terms, together with membership details accepted during sign-up, form the entire contract and replace previous discussions or representations, except where required by law.

15. Governing Law

These Terms are governed by the laws of Victoria, Australia, and disputes are subject to the jurisdiction of Victorian courts.

16. Changes to These Terms

  • The Club may amend these Terms from time to time.
  • Updated Terms may be published on the website, Member Portal, mobile app or displayed in the Club.
  • Reasonable notice of material changes will be provided where required by law.

17. Acceptance

By purchasing, joining or using a membership, Visit Pack or Casual Visit, or by entering the Club, the person acknowledges that they have read, understood and agreed to these Terms.

18. Severability

If any provision is invalid, illegal or unenforceable, it will be severed to the necessary extent and the remaining provisions will continue in effect.
